Supreme Court Snubs DACA Debate

NEWS ALERT: The Supreme Court will not hear a lower court's decision regarding the end of the DACA (Deferred Action for Childhood Arrivals) immigration program. 

 

 

The Supreme Court has thus far denied to hear a lower court's decision that has prevented the Trump Administration from ending DACA, allowing for renewals to continue past the March 5, 2018 deadline. 

 

At least two Federal District Courts, in San Francisco and New York, have found it unconstitutional for the Trump Administration to end DACA.  The Trump Administration stated on September 5, 2017, that no new applications would be accepted and those whose permits were to expire prior to March 5, 2018, could renew.  It further stated that DACA would end on March 5, 2018, giving Congress six months to pass legislation that would help DACA recipients. 

 

The federal courts however, issued injunctions, preventing the Trump Administration from ending DACA, but with some restrictions.  Under the court orders, DACA recipients can continue to renew their work permits.  In addition, if individuals have ever been granted DACA protections, but their status was terminated or they failed to properly renew, they are also eligible to refile for their work permit.  Unfortunately no new applications will be accepted at this time.
